AGREEMENT TO THESE TERMS
By downloading or using Popcorn·Timer (the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. Popcorn·Timer is made by Codenoodle ("we", "our", "us").
WHAT THE SERVICE DOES
Popcorn·Timer uses your device's microphone to detect popping sounds, count them, and alert you when the popping slows to a stop. It works entirely on your device and needs no account. How your audio is handled is described in our Privacy Policy, which forms part of these Terms.
ONE-TIME PURCHASE
Popcorn·Timer is paid for with a single, one-time purchase through Apple's App Store at the price shown before you buy. It is not a subscription — there is no recurring charge, nothing to cancel, and no renewal. The purchase is tied to your Apple Account, so you can restore it on your devices at no extra cost, subject to Apple's rules (including Family Sharing where Apple makes it available).
Apple collects the payment and is the merchant of record. The app itself is licensed, not sold, to you under Apple's Standard End User License Agreement, except where these Terms say otherwise.
REFUNDS
Refunds for App Store purchases are handled by Apple under Apple's policies, not by us. You can request one at reportaproblem.apple.com. If something is not working, we would rather fix it — please tell us first.
NOT A SAFETY DEVICE
Popcorn·Timer is a cooking aid, not a safety device. Pop detection depends on your microphone, the noise around you, your pot, and your stove, and it will not always be right. Never leave cooking unattended and never rely on the app to prevent burning, smoke, or fire. You remain responsible for what is on your stove.
ACCEPTABLE USE
Use the Service lawfully. Do not copy, modify, distribute, resell, reverse engineer, or attempt to extract the source code of the app, except to the extent that applicable law expressly permits it. Do not use the microphone feature to record or monitor other people.
INTELLECTUAL PROPERTY
The Service, including its software, name, design, and artwork, belongs to us or our licensors and is protected by copyright, trademark, and other laws. Your purchase gives you a personal, non-transferable licence to use the app — it does not transfer ownership of anything.
AVAILABILITY AND CHANGES
We may update, change, or discontinue the Service, in whole or in part, at any time. We may also update these Terms; the revision date at the top of this page will change, and continued use after that means you accept the update. We will not, however, retroactively charge you for something you have already bought.
DISCLAIMER OF WARRANTIES
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that pop detection will be accurate or uninterrupted.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss or damage to property (including ruined popcorn, cookware, or worse) arising from your use of the Service. Where liability cannot be excluded, it is limited to the amount you paid for the app. Nothing in these Terms limits rights you have under mandatory consumer protection law.
APPLE
Apple is not a party to these Terms and has no responsibility for the Service. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you. Any claim relating to the app should be directed to us, not to Apple.
GOVERNING LAW
These Terms are governed by the laws of the applicable jurisdiction, without regard to conflict of law principles, and without depriving you of the protection of mandatory law where you live.
